To be eligible to operate over human beings under Category 4, the sUAS must: (1) have an airworthiness certificate issued under Part 21; (2) be operated in accordance with the operating limitations specified in the AFM or as otherwise specified by the Administrator (the operating limitations must not prohibit operations over human beings); and (3) have maintenance, preventive maintenance, alterations, or inspections performed

A refusal to submit to a test to indicate the percentage by weight of alcohol in the blood, when requested by a law enforcement officer, or a refusal to furnish or authorize the release of the test results requested by the Administrator, is grounds for denial of an application for a Remote Pilot Certificate with an sUAS Rating for a period of up to 1 year after the date of that refusal; or suspension or revocation of a Remote Pilot Certificate with an sUAS Rating.Answer (A) is incorrect because the remote pilot applicant could be denied application for up to 1 year after the date of refusal. Answer (B) is incorrect because the operator could risk having their remote pilot certificate suspended or revoked.

A conviction for the violation of any federal or state statute relating to the growing, processing, manufacture, sale, disposition, possession, transportation, or importation of narcotic drugs, marijuana, or depressant or stimulant drugs or substances is grounds for denial of an application for a Remote Pilot Certificate with an sUAS Rating for a period of up to 1 year after the date of that act.

To be eligible to operate over human beings under Category 3, the sUAS must meet a means of compliance (MOC) and be listed on a current Declaration of Compliance (DOC) with the FAA and display a label on the sUAS indicating Category 3 eligibility

This operation is recreational in nature. However, Part 48 "Registration and Marking Requirements for sUAS" applies for all operations of an sUAS over .55 pounds, whether for work of your own enjoyment.

No person may act or attempt to act as a crewmember of an sUAS within 8 hours after the consumption of any alcoholic beverage. Remember "8 hours bottle to throttle."

The Pilot's Handbook of Aeronautical Knowledge (FAA-H-8083-25) provide information on the physiological effects of alcohol, prescription drugs, and OTC medications.

The remote PIC must be able to maneuver the sUAS to avoid a collision and prevent other aircraft from having to take evasive action.

Night operations require an sUAS to have anti-collision lighting visible for at least 3 SM that has a flash rate sufficient to avoid a collision.
